Most employees do not understand very much about employment law. They should however because employment law governs the duties and rates between a worker and employer. Employment law may also be known as labor law. These type of laws have been introduced to make sure that workers are treated fairly and that they are kept safe. The laws also have been introduced for the additional benefit of the employer.

An employment law is founded on state or federal constitutions, rules of administration, legislation, and court findings. There also may be an employer/employee relationship by means of a contract. Employment laws have an interesting history in the United States of America and all employees should try to understand a little bit about this history.

The labor laws of America go back to the Industrial Revolution when there was a public outcry towards the many oppressive practices during the time of this revolution. The early 20th century saw the first changes in regards to minimum wage, injured workers compensation, a standard workweek, and the outlawing of child labor.

Some of the employment laws that were brought to the forefront during the 1960s and 70s included unsafe work conditions and discrimination. Today, some of the employment laws that are making headlines include equal pay for women and men and healthcare. Employment laws have progressively changed throughout the centuries and will continue to do so in the future.

There are many employment law disputes and litigation that involve hour and wage violations. The federal government has established baseline laws and rules to help govern these issues. Each individual state then can decide whether to pass these laws with additional protections. Let’s say for example that the federal government has established an $8.00 per hour minimal wage. Any state can increase that amount and all employers of that state must comply.

Hour and wage laws also govern overtime pay. The federal government of the United States has not placed any limits on the number of hours that an adult can work each week. They have however made a law that states that anyone who works more than 40 hours in a week must receive at least time and a half. There are also various laws to control the working conditions and hours of any worker who is under the age of 18.

Therefore, as you can see, these basic laws should be known and understood by every employee and employer.
